Effective date: 1 October 2024.

1. General Provisions

1.1 The Affiliate Advertising Network ‘Perks’ (hereinafter - the ‘Network’) offers advertising and promotion services on the Internet on platforms such as Telegram, Instagram, Facebook, Google Ads, Yandex Direct and other digital channels.

1.2 These Terms and Conditions regulate the use of the Network services by Partners (hereinafter referred to as ‘Partners’). The Partner's use of the services implies consent to these Terms and Conditions.

1.3 The Network reserves the right to change the Terms and Conditions at any time with notice to the Partners. The changes come into force from the moment of their publication on the official website.

2. Registration and Account

2.1 In order to access the Network services a Partner must pass the registration process, indicating true and up-to-date information.

2.2 The Partner undertakes to keep his/her registration data up to date and is responsible for the safety of login data.

2.3. The Network reserves the right to suspend or cancel the Partner's account in case of violation of the Terms and Conditions or incorrect use of the platform.

3. Services and Obligations of the Network

3.1 The Network provides Partners with tools to promote their advertisements, which may include placement on various digital platforms such as Telegram, Instagram, Facebook, Google Ads, Yandex Direct and others. However, the Network does not guarantee mandatory placement on these platforms. The possibility of promotion on specific platforms depends on the availability of these channels from the Partners of the system.

3.2 The Network is obliged to provide up-to-date information about the possibilities of advertising promotion, available formats and cost, based on the available advertising channels in the system at the moment of use.

3.3 The Network is not responsible for availability of advertising platforms and their placement conditions, as they may depend on the system Partners and external factors.

4. Partner's obligations

4.1. An Introducing Broker is obliged to provide accurate and reliable information about his/her goods or services.

4.2. A Partner is not entitled to place advertisements violating the legislation of Uzbekistan or containing prohibited content (including but not limited to pornography, propaganda of violence, hatred, discrimination).

4.3 The Partner is obliged to comply with the terms and conditions of each advertising platform where his/her advertisements are placed (Telegram, Instagram and others).

4.4. The Partner is responsible for timely payment for the Network services.

5. Payment and Refunds

5.1 The cost of the Network services is specified in the agreement between the Network and the Partner or in the corresponding tariff plans published on the Website.

5.2 All payments must be made within the established terms.

5.3 Refunds are possible only in case of cancellation of the service before its provision or in cases of obvious error on the part of the Network.

6. Limitation of Liability

6.1 The Network is not liable for losses or damages caused by the Partner's improper use of advertising tools.

6.2 The Network does not guarantee uninterrupted operation of the services or absence of failures in operation of advertising platforms.

7. Privacy and Security

7.1 All data provided by the Partner are protected and used only for the purposes of providing services of the Network.

7.2. The Network undertakes not to disclose personal data of Partners to third parties, except for the cases stipulated by the legislation.

8. Settlement of Disputes

8.1. All disputes arising between an Introducing Broker and the Network shall be settled by negotiations.

8.2 In case of impossibility to settle a dispute amicably, it is subject to consideration in the courts of Uzbekistan in accordance with the current legislation.

9. Final Terms

9.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of Uzbekistan.

9.2 The use of the Network services after amendments to the Terms means the Partner's consent to the new terms and conditions.
